Kristin Machelor has been defending workers’ compensation claims since 2005 and GML 207-c claims since 2000. She has handled hundreds of trials at the Workers’ Compensation Board (WCB), including lay witness testimony and medical testimony on the issues of fraud, accident, notice and causal relationship, period and extent of disability, as well as entitlement to medical benefits, permanency and loss of wage earning capacity  She has prior success before the Appellate Division on issues including fraud and GML 207-c.

She has also advised clients on establishing GML 207-c claims handling procedures, represented clients at hearings on questions of eligibility and light duty capability, and works to coordinate the defenses of both GML and WCL claims available to the client at the outset.  She has spoken on this topic at continuing legal education and municipal claims seminars and appeared before the New York State Supreme Court as well as the Fourth Department in further defense of these matters.

As part of her practice, Kristin Machelor consistently conferences with employers and witnesses in advance of trials and hearings to ensure proper exhibits and testimony are presented in manner most favorable to defenses. In addition, she provides careful analysis of evidence as defenses such as fraud are developed in order to provide proper handling guidance in compliance with legal standards.

Prior to joining MAD, Ms. Machelor was a partner at Hamberger & Weiss and worked as an Assistant County Attorney assigned to the Erie County Sheriff’s Office.  She has seventeen years of experience handling hearings including arbitrations, administrative hearings regarding 207-c and workers’ compensation benefits.  She is a member of the Erie County Bar Association Workers’ Compensation Committee and the New York State Bar Association Local Government Committee.
